## Agreed Settlement Order
This matter coming before the Court for trial setting due notice given to all parties, and all parties present via Zoom, it is hereby ordered:
### 1. Resolution Agreement
The parties agree to resolve this matter to avoid further litigation.
### 2. Past Due Balance Acknowledgment
- Defendants agree that the full past due balance owed is **$26,551.00**
- Represents all past due rent and court costs due under the lease through April 2026
- Includes $551.00 in court costs
- Plaintiff is holding a security deposit of **$4,000.00**, which Plaintiff may apply towards the balance owed
- Balance after security deposit: **$22,551.00** ("Past Due Balance")
### 3. CBRAP Application
- Parties submitted a joint application for the Court-Based Rental Assistance Program ("CBRAP")
- Seeking maximum available assistance of **$10,000.00**
- Application currently in review status
### 4. Stay Condition - Monthly Rent
- Defendants are staying in the unit
- Must make all future monthly rent payments of **$2,000.00** as they come due
- **First monthly rent payment due by May 1, 2026**
### 5. Compliance Hearing
- Matter continued to **June 3, 2026, at 9:30 am** in Courtroom 1402 via Zoom for status on compliance
### 6. If CBRAP Approved for Full $10,000
If rental assistance is approved for the full $10,000.00, and Defendants are in compliance with Section 4:
- Funds will be applied to the past due balance
- Any remaining balance will be waived
- Case will be dismissed with prejudice
- File will be sealed
### 7. If CBRAP Approved for Less Than $10,000
If rental assistance is approved for an amount less than $10,000.00:
- Defendant will owe the deficiency between $10,000.00 and the rental assistance funds received ("Deficiency")
- Deficiency shall be paid in **six (6) equal monthly installments**
- Payments begin on the 15th of the month following receipt of rental assistance funds
- Continue on the 15th of each subsequent month until Deficiency is paid in full
### 8. If CBRAP is Denied
Defendant shall have the option to either:
**Option (1) - Vacate:**
- Vacate the property within 30 days of notice of denial
- If Defendant vacates within said 30 day period, the possession count will be dismissed with prejudice
- AND either:
- (i) Pay $10,000.00 in ten (10) equal monthly installments of $1,000.00 beginning on the 15th of the month following notice of denial, OR
- (ii) Choose to have a judgment for money only entered for the full Past Due Balance, less any payments made
**Option (2) - Stay and Pay:**
- Stay in the property
- Pay $20,000.00 of the Past Due Balance
- Paid in twenty (20) equal monthly installments of $1,000.00
- Beginning on the 15th of the month following notice of denial until paid in full
### 9. Failure to Pay Future Rent
While parties await the decision on rental assistance:
- If Defendants fail to pay any future monthly rent payments by the 1st of every month (per Paragraph 4)
- At the earlier of the compliance hearing, or upon notice and motion to enforce the terms of this Agreed Settlement Order
- **Plaintiff shall be entitled to:**
- Immediate eviction order
- Judgment for $26,551.00, plus any unpaid future rent after April 2026, less any payments made
### 10. Use and Occupancy
By agreement of the parties, Plaintiff is granted use and occupancy to accept payments towards the Past Due Balance and for future rent as such rent comes due.
### 11. Default Consequences
If Defendant fails to comply with any of the terms of this agreement:
- Plaintiff will be entitled to an eviction order, instanter
- Money judgment for $26,551.00, plus any unpaid future rent after April 2026, less any payments made
