VACATION RENTAL
MANAGEMENT AGREEMENT
Welcome to Evolve!
We are pleased that you are choosing Evolve to provide services for your vacation rental property and want
you to be fully informed about the services we provide and the terms on which we provide them. This
Agreement is important, and you should read it carefully. It contains information about your rights, remedies,
and obligations when you use our Services.
PLEASE NOTE THAT THIS AGREEMENT CONTAINS AN ARBITRATION CLAUSE, CLASS ACTION
WAIVER, AND JURY TRIAL WAIVER.
1. Parties and Effective Date
This Vacation Rental Management Agreement (the “Agreement”) is between Evolve Vacation Rental
Network, Inc. and its affiliates (“Evolve,” “we,” “us,” or “our”) and you (“you,” “your,” or “Owner”). Evolve
does business through local affiliates or licensed representatives in certain states; please reference the Evolve
Licensed Partner page on the Site to determine whether an affiliate or licensed partner is active in your state.
The Evolve Licensed Partner page may be updated from time to time without requiring amendment to this
Agreement. If you are new to Evolve, the Agreement is effective when you submit your online registration and
indicate your acceptance of this Agreement. If you are already an Evolve homeowner, this Agreement becomes
effective as of July 2, 2025 and replaces completely the previous agreement between you and Evolve.
2. Overview of Evolve Services
2.1 Overview. Evolve operates www.evolve.com and related subdomains and mobile applications (the
“Site”), and performs marketing, booking, and related services for Owners seeking to supply a vacation rental
property or properties (your “Property”) and users seeking to learn about properties for rent (a “Guest”) and, if
they wish, to book a stay (our Site and services, collectively, our “Services”). The Services are further
described throughout this Agreement. Evolve lists Owner’s vacation rental properties for rent on the Site and
on vacation rental sites or marketing channels operated by others (“Third-Party Marketing Sites”). Evolve may
provide varying levels of Service offerings to Owners. The current offerings are described in the subsections
below:
2.1.1 Core. Unless you elect a different offering, you will be automatically enrolled in the Evolve
Core offering. For more information on the Core plan, please see the Core section on the Evolve Core
Plan page. Other than the terms specifically identified as a different offering, the Evolve Core terms
are those described throughout the Agreement.
2.1.2 Plus. If you are accepted and enrolled in the Evolve Plus offering, the additional terms in
Section 5.5, Section 8.1, Section 9.10 described as “Plus” apply. For more information on the benefits
of the Plus plan, please visit the Evolve Plus Plan page. You must specifically request enrollment in
the Plus offering. Acceptance of any Property into the Evolve Plus offering is at Evolve's sole
discretion.

2.1.3 Custom. If you are accepted and enrolled in any other custom offering, the additional terms of
your Custom Addendum or Custom Agreement will be provided to you. Acceptance of any Property
into a custom offering is at Evolve's sole discretion.
2.2 Exclusive Reseller. Owner grants Evolve the right to promote, market, and rent the rental
inventory at the Property to Guests and potential Guests directly or indirectly including through Third-Party
Marketing Sites. You agree that Evolve will be your exclusive marketing and booking partner, meaning that
that you will not advertise (or permit any third party to advertise) your Property, online or offline, through
travel agencies, vacation rental marketplaces or listing sites, or via property managers or other services or
platforms of any kind, including without limitation Third-Party Marketing Sites.
3. Term and Termination
3.1 Term. This Agreement is effective between you and Evolve until terminated (the “Term”). Owner or
Evolve may terminate the Agreement at any time as described below.
3.2 Owner Termination; Onboarding Fee. You may, for any reason and at any time, cancel our Services
for all, or a portion of, your Property by providing notification via email to success@evolve.com and your
termination will be effective 15 days following our receipt of your notice. The terms of this Agreement shall
continue to apply to any Bookings (defined in Section 6.2 below) confirmed prior to such notification and
shall remain effective until all such Bookings are completed. Evolve will invest a significant amount of time
and money into creating a professional listing for your Property (the “Listing”). If you are not utilizing
Evolve’s Service within the first 90 days of accepting this Agreement for any or no reason, you agree that
Evolve will retain an onboarding fee to compensate Evolve for onboarding your Property; you authorize
Evolve to collect the onboarding fee using your credit card or other payment method on file, by deducting
the fee from Owner Payouts, or by debiting your bank account. For clarity, you agree to pay Evolve this
onboarding fee if you a) terminate the Agreement prior to or during the first 90 days that your listing is
activated; or b) if you fail to make a reasonable effort to activate your listing within 90 days of accepting the
Agreement.
3.3 Evolve Suspension or Termination. We may, in our sole discretion and without liability to you, with
or without cause, for any reason or no reason at all, and with or without prior notice suspend or terminate
your access to our Services; or modify or discontinue, temporarily or permanently, any portion of our Services.
If Evolve terminates this Agreement and your access to our Services, Evolve will notify you and the
termination will be effective on the date identified in the notice. If Evolve terminates this Agreement due to
your breach, any existing Bookings at your Property will be considered Owner Cancellations as described in
Section 10.
3.4 Confirmed Bookings; Survival. Owner will honor any Bookings scheduled for the Property prior
to termination of the Services and this Agreement will survive for that time with respect to those
Bookings.
4. Authority and Eligibility. Owner represents, warrants, and agrees:
