## COMPLAINT SUMMARY

American Power & Gas enrolled me in a variable-rate electric supply plan via phone solicitation in or around February 2025, with service starting approximately April 15, 2025. The representative quoted a competitive initial rate but failed to disclose that:

1. The rate was variable and could increase without notice
2. The rate would exceed National Grid default supply rates by 200-300%
3. There was no written confirmation of the variable rate terms per NY ESCO reform requirements (16 NYCRR Part 10)

## DISCLOSURE VIOLATIONS

- **No written contract exists.** APG confirmed on June 10, 2026 that they have no written contract — only a verbal recording made during the enrollment call. This directly violates 16 NYCRR Part 10, which requires ESCOs to provide written disclosure of variable rate terms before or at the time of enrollment. A call recording is not a substitute for written disclosure.
- No written confirmation of variable rate terms received before service began
- No clear disclosure that rate could triple within months
- No "meaningful benefit" test met — APG rates consistently 2-3x higher than default
