If approved, this proposal will provide the Polonia DAO with the authority to file the Prospective Lawsuit, but will not obligate or require the Polonia DAO to actually file the Prospective Lawsuit. Litigation mechanics and strategy will be finalized at a later date, subject to the advice and recommendation of counsel. - If approved, this proposal authorizes Lofty to identify counsel to represent the Polonia DAO in connection with the Prospective Lawsuit, understanding that Lofty is willing to pay for those legal costs and expenses reasonably incurred by the Polonia DAO in connection with the Prospective Lawsuit. - This proposal is being submitted based upon information and belief that Yhome Nursing LLC and/or Calixte Duffaut (collectively, “Yhome”) breached their agreement(s) with the Polonia DAO and its members, and/or otherwise engaged in wrongful and/or illegal conduct with respect to 6914 Polonia Ave Cleveland, OH 44105 (“Polonia” or the “Property”) and the management thereof. More specifically, the conduct motivating this proposal includes, but is not limited to, the following: - Yhome wrongfully withholding $64,268 in sale proceeds from investors. - Yhome’s purchase of 62 Folcroft Ln using proceeds owed to investors, of which he wrongfully owns 100% of the property. - If approved, this proposal authorizes Earl Vanze Co to serve as the single point of contact for the DAO and liaison to legal counsel on behalf of the DAO, and further authorizes Earl Vanze Co to receive any and all litigation updates from legal counsel on behalf of the DAO, and to make any decisions with respect to the prospective litigation and to authorize any action in the prospective litigation on behalf of the DAO. Let me be clear, if you did not vote to buy the property, you were drug along and included anyways even though it was an "individual" vote. Like I said before, I am unable to refinance the property and bring it to the market. For now we still have a new roof to install and we have no funds for it. Please review the pictures that show the work that was done. The plan was to bring this as a rent by the room padslip model etc with a possible gross of $3100. I want to affirm that, from the very beginning, Yhome has diligently worked to deliver exactly what was promised. All the allegations against us have been proven to be untrue. However, the actions taken by some have resulted in losses for Yhome, the DAO, and all involved parties. - I respect your right to make your own decisions, just as I chose to invest on Lofty and accepted the challenge to assist with properties in Cleveland and Chicago. The results of those efforts speak for themselves (despite the accusations). - I also want to inform you that the lender will not permit the transfer of titles for any properties. This outcome was a direct result of investors contacting the lender and making accusations. I have met with the lender, and it was made clear that all actions taken by Yhome were legally compliant. - Nevertheless, I must deal with the consequences—both for myself, the DAO, and the platform. I encourage you not to fall for misinformation. Please request anyone submitting votes based on accusations to provide supporting proof. - Regarding the Folcroft property: it is completed, with only cleaning and final touch-ups remaining. Our plan was to refinance and bring the property back onto the platform. However, as you can see, the lender has refused to do any refinancing. Meanwhile, some investors seem intent on damaging my contacts, credibility, and both my business and personal credit. Such actions will ultimately harm everyone involved. - The property is finished, and I am doing my best to protect your investment. This update demonstrates that I have followed through on my commitments. The next steps may include selling the property or seeking a different lender. Prior to our involvement, this property remained on the market for 143 days. Once Yhome took over, we revitalized the property, which was originally purchased for $100,000 according to Lofty’s records, and sold it for $130,000 ( instead of 67k as is). As promised, we did not incur a loss on this sale. - We are now moving forward with the Folcroft project.
