Plaintiff, HOLLY HILL FUNDING, LLC sues Defendants, YHOME NURSING, LLC, a

Florida limited liability company, CHERRY LFTY0412 DAO, LLC, a Wyoming limited liability
company, NATASHA DUFFAUT, and CALIXTE DUFFAUT and alleges:
GENERAL ALLEGATIONS

1.

This is an action to foreclose a mortgage on non-homestead, residential real

property located in Flagler County, Florida with a debt balance in excess of $50,000.00.
2.

Plaintiff is a Florida limited liability company doing business in Flagler County.

3.

Defendant YHOME NURSING, LLC (““YHOME?”), is a Florida limited liability

company doing business in Flagler County, Florida.
4.

Defendant, CHERRY LFTY0412 DAO, LLC (Cherry 412) appears to be the record

title owner of the subject Property by virtue of a quit claim deed from YHOME.
5.

Defendant Natasha Duffaut is an individual residing in Palm Coast, Florida.

6.

Defendant Calixte Duffaut is an individual residing in in Palm Coast, Florida.

Venue is proper in Flagler County because the real property which is the subject of

this litigation is located in Flagler County, Florida and the cause of action arose in Flagler County,

All conditions precedent to bringing this action have occurred or been waived.

Plaintiff has retained undersigned counsel to represent its interests in this action

and is obligated to pay for the legal services rendered herein.
COUNT I- MORTGAGE FORECLOSURE
(Against All Defendants)

Plaintiff realleges and restates the allegations contained in paragraphs 1 through 9

above as if fully set forth herein.

This is an action to foreclose a mortgage on real property in Flagler County, Florida

(the “Property”) being more particularly described as:
Lot 25, Block 6, Map of Belle Terre – Section 12, Palm Coast,
according to the map of plat thereof as recorded in Plat Book 6,
Page 73, Public Records of Flagler County, Florida.
More commonly known as: 49 Bannbury Lane, Palm Coast,
Florida 32137
12.

On May 30, 2023, Defendant YHOME made, executed and delivered a promissory

note which was an amended and restated promissory note (the “Note”). A true and accurate copy
of the Note is attached hereto and incorporated as Exhibit “A.”
13.

A Real Estate Mortgage and Security Agreement securing payment of the Note to

Plaintiff was executed and delivered on May 30, 2023 (the “Mortgage”). The Mortgage was
recorded on June 1, 2023, at Book 2784, Page 0009 of the public records of Flagler County, Florida
and mortgaged the Property described in the Mortgage. A true and accurate copy of the Mortgage
is attached hereto and incorporated as Exhibit “B.”
