Duffaut and Calixte Duffaut 52 Point Pleasant Drive Palm Coast, FL 32164 NOTICE OF DEFAULT AND ACCELERATION OF DEBT Re: Promissory Note: $ 346,500.00 Princ i pal / November 14, 2023 Mortgage: November 14, 2023 Secured Property : 27 Pillar Lane, Palm Coast, FL 32164 Borrower: YHome Nursing, LLC Personal Guarantor: Natasha V. Duffaut and Calixte Duffaut Lender: Holly Hill Funding, LLC Dear YHome Nursing , LL C, Ms. Duffaut, and Mr. Duffaut : I represent the Lender in all matters pertaining to the above referenced Promissory Note and Mortgage . The Promissory Note and Mortgage were executed on the above referenced date and the above referenced Secured Property serves as collateral for the debt . The Borrower has failed to pay monthly installments due under the loan documents beginning on June 1, 2025. Further, the Borrower has materially defaulted by transferring interest in the Property to another entity without consent of or notice to the Lender on or about April 26 , 2024 . Consequently, the Borrower and Personal Guarantor are in default under the terms of both the Note and the Mortgage. The purpose of this letter is to give you notice that the debt is due in full as of the date of this letter th e Lender elects to accelerate the debt pursuant to the terms of the Note and Mortgage. Lender declares the entire principal and accrued interest remains immediately due and payable and makes this formal demand for such payment from the Borrower and guarantor jointly and severally. You are hereby directed to immediately pay the following sums: *You must contact Lender or my office for an updated payoff balance. Interest continues to accrue daily on the principal balance at a rate of 18% or per annum pursuant to the terms of the Note ($ 170.88 per diem). Payment of the amount due should be made by money order, official bank check, or other certified funds payable to “Holly Hill Funding, LLC ” and forwarded to Lender as follows: Holly Hill Funding, LLC. ATTN: Patrick Sullivan Post Office Box 1871 Flagler Beach, FL 32136 Failure to remit payment in full to my office on or before 15 days from your receipt of this letter may result in Lender exercising all its rights and remedies under the documents evidencing the Note and Mortgage, at law and in equity, including, without limitation, the institution of legal action to recover the amount due and the institution of foreclosure proceedings on the secured property. Please be advised that under the terms of the Promissory Note and Mortgage, you will be liable for all collection costs incurred by Lender in this action including but not limited to court costs and attorneys’ fees whether or not a lawsuit is instituted against you. To the extent this communication is deemed as coming from a debt collecto r, t his is an attempt to collect debt, and any information obtained will be used for that purpose. Unless you dispute the validity of the debt within thirty (30) days after receipt of this letter, the debt shall be assumed to be valid. If you do notify me in writing within thirty (30) days after receipt of this letter that the referenced debt, or any portion thereof, is disputed, I will mail verification of the debt to you.
