Dear Kathie Nguyen,
Introduction:
Great American E&S Insurance Company (“Great American”) is writing to notify you of the status of the
reported wind damage claim at the above-noted loss location.
Policy Information:
Great American insures Lofty Holding 25 Circle Drive DAO LLC under Policy E927023 with a policy
effective date of January 24, 2024, until January 24, 2025.
Please review the attached appendix for policy language relating to this claim.
Facts of Claim:
We received notice of this wind damage claim on July 10, 2024. Upon receipt of the claim, we assigned
Mike Ohlman with Cross Country Adjusting to inspect the damage and he completed that task on July 15,
2024. Mr. Ohlman’s report confirmed there was a fallen tree in the yard. I have included Mr. Casias’
inspection photos for your review.
Analysis:
Per Mr. Ohlman’s inspection of the property he observed a tree had fallen in the yard. Outside of the tree
itself, Mr. Ohlman was unable to observe any wind damage to the insured property.
Per the policy language cited in the appendix below, there is no coverage for damage to trees unless the
damage is caused by fire, lightning, explosion, riot, civil commotion, or aircraft. None of those causes of

loss damaged your tree. Additionally, land is not covered property under your policy. Therefore, Great
American respectfully declines coverage for the reported damage.
Conclusion:
Please note failure to mitigate the damage and promptly repair the damage will jeopardize coverage for
any future covered losses that may result from this occurrence.
No actions taken by Great American in the investigation of this matter shall be construed as a waiver of
any of the rights that may be available to it, including the right to deny or limit coverage. In addition, this
letter should in no way be construed as a waiver or estoppel of any coverage position afforded by
applicable law or the policy. If you have any information, whether or not requested herein, which may be
pertinent to our investigation, we ask that you forward it to us immediately for our review and
consideration.
Part 919 of the Rules of the Illinois Department of Insurance requires that our company advise you that, if
you wish to take this matter up with the Illinois Department of Insurance, it maintains a Consumer
Division in Chicago at 122 S. Michigan Ave., 19th Floor, Chicago, Illinois 60603 and in Springfield at
320 West Washington Street, Springfield, Illinois 62767.
