Dear Ms. Nguyen:
As you are aware, we are the independent adjusting firm retained by Certain Underwriters at Lloyd’s of
London relative to the claim submitted for the sewer damage to the property at the above loss location.
Certain Underwriters at Lloyd’s, London issued Policy Number 4-549-1-0000 to Lofty Holding 13806 Coit
Road DAO LLC for the effective dates of March 16, 2023 to March 16, 2024. Coverage is provided for
Commercial General Liability Coverage in the amount of $100,000 with a $500 deductible, Skip Rent in
the amount of $1,000 with no deductible and Tenant Property Coverage in the amount of $10,000 with
a $500 deductible. Endorsement 2 on the policy effective as of December 15, 2022 limits sewer & drainup coverage to $10,000 with a $500 deductible.
Upon receipt of assignment, we assigned Ryze Claims Solutions who dispatched Ms. Beth Bill Oldford to
investigate the loss and damage. Ms. Oldford inspected the loss location on December 1, 2023. The
sewer drain had backed up due to prior tenant pouring grease into the basement drain lines. The lines
will need to cleaned out and repaired in order for proper drainage to occur. The pipes themselves are
not covered under the Tenant Protection Policy. As well, there was mold noticed on a wall in the
basement and the policy specifically excludes coverage for mold.

SECTION I – COVERAGE
B.

Covered Property
“Covered property”, as used in this Coverage From, means:

1. Any “building” that is described in the “Declaration” or any “endorsement” belonging
to you or for which you are legally responsible, including:
a. Completed additional and permanently installed machinery and equipment;
b. Personal property of other “renters” that is in the “building” described in the
“Declarations”.

“Covered Cause of Loss”
“Covered cause of loss” means any of the following provided that it arises out of the
accidental acts or omissions of the “renter” against whom a “claim” has been made:
1. Fire
2. Explosion, including the explosion of gases or fuel within the furnace of any fired
vessel or within the flues or passages through which the gases of combustion pass.
This cause of loss does not include "loss or damage" by:
a. Rupture , bursting or operation of pressure relief devices; or
b. Rupture or bursting due to expansion or swelling of the contents of any "building"
or structure, caused by or resulting from water.

3. Smoke causing sudden and accidental "loss or damage ". This cause of loss does not
include smoke from agricultural smudging, industrial operations, or tobacco.
4. Water that backs up or overflows from a sewer, drain or sump.
5.

Water or other liquid which leaks, flows or overflows from plumbing, heating, air
conditioning or other equipment or fixtures.

SECTION Ill – CONDITIONS
A. "Limit of Insurance"
Regardless of the number of "claims", "renters" against whom such "claims" are made or persons
bringing such "claims", the most we will pay as the result of any one claim under this Coverage Form or
series of claims arising directly or indirectly out of the same originating cause or series of similar causes
is the "Limit of Insurance".
