LEASE AGREEMENT ONMarch1,2025,YHOMENURSING,LLC(the“Lessor”),whoseaddressis52PointPleasant Drive, Palm Coast, FL 32164 and Maritza Rodriguez Hernandez and Juan Colon (the “Lessee”), whose address is 122 Florida Park Dr, Palm Coast, FL 32137, enter into this LEASE AGREEMENT (the “Agreement”), whereby Lessor hereby leases to Lessee, and Lessee hereby leases fromLessor,certainrealpropertyownedbyLessor,andmorefullydescribedbelow,subjecttotheterms and provisions hereinafter set forth in this Agreement. 1. Description of Property. The leased property consists of that residential dwelling and surrounding yard owned by Lessor and located at 122 florida Park Dr,PalmCoast,FL32137, (the “Premises”), and further described as: Lot11,Block 22, FLORIDAPARK-SECTION-7 PALMCOAST, a subdivision accordingto the plat thereof recordedin Plat Book 6, Pages18 through 27, ofthePublic Records ofFlagler County,Florida, asamended by 2. 3. instrumentrecordedin Official Records Book35, page528, of the public records of Flagler County, Florida Term.ThetermofthisLeaseshallcommenceasofMarch1,2025andshallexpireat11:59p.m. on March 1, 2027 (the “Term”). Lessee shallhave(1)additionalone-yearoptiontorenewthe LeaseuntilMarch,2028uponpaymentofanadditional$10,000non-refundableoptionfeetobe applied against the Purchase Price if the option is exercised. 4. Basic Rent. Lessee shallpaytoLessorasbasicrentequalmonthlyinstallmentsof$2,200each duringthefirst24monthsoftheTerm,Thefirstofwhichshallbepayableupontheexecutionof this lease and the remaining monthly installments shall be payable on the 1st day of each successivemonth.TheLesseeshallberesponsibleforallsalestaxesorothertaxeswhichareor may be imposed on rentals. InadditiontotherightsoftheLessorassetforthinParagraph19 below,ifanypaymentofrentismorethan5dayslate,atthetimeLesseepaystoLessorthelate rent,theLesseeagreestopay$50.00perdayasadditionalrenttotheLessorforeachdaythatthe payment is late. 5. PlaceofPayments.LesseeshallmakerentpaymentstoLessorattheaddressforLessorsetforth above or at such other place as may be designated by Lessor from time to time. 6. Security Deposit.N/A 7. PaymentofRent.LesseepromisestopaytoLessoreachandeveryinstallmentofrent,together with sales tax and additional rent if applicable, when the same shall become due, the time of paymentofeachrentinstallmentbeingmadetheessenceofthisAgreement.Allrentalsprovided forinthisAgreementshallbepayablewithoutnoticeordemand,unlessspecificallyprovidedto the contrary in this Agreement. 8. Net Rent. It is the intention of Lessor and Lessee that the renthereinspecifiedshallbenetto LessorthroughoutthetermofthisAgreement,exceptasmaybeotherwisespecificallyprovided in this Agreement. All taxes, charges, costs and expenses which Lessee is required to pay hereunder,togetherwithallinterestandpenaltiesthatmayaccruethereonintheeventofLessee's failure to pay such amounts, and all damages, costs and expenses which Lessor may incur by reason of any default of Lessee or failure on Lessee's part to comply with the terms of this Lessor Initials Lessor Initials Lessee Lessee Initials Initials Agreement, shall be deemed to be additional rent and, in the event of nonpayment byLessee, Lessor shall have all the rights and remedies with respect thereto as Lessor has for the nonpayment of the basic rent. 9. Taxes and Insurance.During the term of this Agreement, Lessor shall pay: (a) Alladvaloremrealpropertytaxesorspecialassessmentsproperlyassessedagainstthe Premises. Any taxes due on Lessee’s personal property shall be the sole obligation of Lessee; and (b) The cost of insurance in such coverageamountsasLessormayreasonablydetermine, with casualty insurance coverage insuring the Lessor against loss ordamagebyfireor other hazards included within the term “extended coverage,” on areplacementbasisat full insurable value of all improvements constructed on the Premises. Lessee shall be responsible for insuring Lessee’s personal property. 9. Payment of Association Fees.N/A. 10. Repairs and Maintenance. Throughout the term of this Agreement, Lessee, at Lessee's sole expense, shallmaintainthegrounds,lawn,treesandshrubsinaneatandhealthycondition,and free of refuseanddebris;maintainallappliances,mechanicalitems,heating,cooling,electrical, plumbing, water, sewer, and mechanical systems machinery in good working order good and repair;andmaintaintheroof,windows,doors,andallremainingexteriorandinteriorportionsof the Premises in good working order and repair. Lessor shall have no obligation to repair or replace anything during the term of this Agreement. 11. UseofPremises.LesseeshallnotuseorpermitthePremisestobeusedforanyillegal,immoral orimproperpurposesorpermitanywaste,nuisance,disturbance,noiseorannoyancewhatsoever detrimental to the Premises or to adjoining condominium unitsortheiroccupants.Lesseeshall comply with all requirements of law and with all ordinances, regulations and orders of governmental authority. The Premises shall be occupied by Lessee and her immediate family. WithoutthepriorwrittenconsentofLessor,additionalpersonsmayoccupythePremisesonlyas invitees and for a period of time not to extend beyond 10 days. Except as required by law, without the prior written consent of Lessor, Lessee shall not have any pet or animal on the Premises. 12. Acceptance of Premises. Lessee'soccupancyofthePremisesshallconstituteacceptanceofthe Premisesin“asis”condition,andaconfirmationtotheLessorthatthePremisesareingoodand satisfactoryconditionandacceptabletoLessee.LesseeshalltherebyreleaseLessorfromanyand allclaimsarisingfromanydefectintheconditionofthesaidPremisesorthepropertyofLessor of which said Premises are a part, or the equipment, fixtures or appliances in or serving said Premises and the property of which they are a part. 13. Utilities.LesseeshallpayforanyandallutilityservicesdesiredbyLesseeforthePremises,and shall indemnify and hold Lessor harmless with regard to the same. Lessor shall not be responsible or liable for any interruption or failure of any utility service. 14. Right of Entry; Safeguarding.
