I appeal the Notice of Civil Offense issued to me on the following grounds. I am attaching
evidence in support of my appeal.
The property was not an active rental unit at the time of citation (2/27/2026). It has been vacant for an

extended period and is currently under contract for sale with a scheduled closing date of 4/7/2026.

The Lead-Safe Certification ordinance applies only to active rental units. Therefore, the ordinance does

not apply. Even if considered a rental, there was no tenant occupancy at the time of citation, and therefore
______________________________________________________________________________
no tenant exposure to lead risk. Enforcement under these circumstances is improper.
